Terms and Conditions

1. DEFINITIONS

  • “Company”, “we”, “us”, “our”: Emerico, the registered legal entity providing mobility products and services.
  • “Customer”, “you”, “your”: The individual or organization purchasing or renting Products from Emerico.
  • “Product(s)”: Any wheelchair, mobility aid, accessory, or related item supplied by Emerico.
  • “Rental Agreement”: The contract governing the temporary use of Products.
  • “Purchase Agreement”: The contract governing outright purchase of Products.

2. GENERAL

2.1. These Terms & Conditions (“T&C”) apply to all sales and rentals of Products by Emerico to the Customer.

2.2. By placing an order, making payment, or accepting delivery/rental, you agree to be bound by these T&C.

2.3. Emerico reserves the right to amend these T&C at any time. The latest version will be posted on our website and applies to all subsequent transactions.

3. PRODUCT INFORMATION & ORDERS

3.1. All product details, images, and descriptions are provided for reference only. Actual products may vary slightly.

3.2. Emerico reserves the right to modify specifications, discontinue products, or update pricing at any time without prior notice.

3.3. Orders are subject to acceptance and stock availability. Emerico may refuse or cancel any order at its discretion.

3.4. Customers are responsible for ensuring that products meet their intended use and requirements.

4. PURCHASE TERMS

4.1. Payment

  • Payment must be made in full (or as otherwise agreed in writing) before delivery.
  • Accepted payment methods include bank transfer, credit/debit card, or other methods as specified by Emerico.
  • All prices are in Malaysian Ringgit (MYR) and inclusive/exclusive of taxes as indicated.

4.2. Delivery

  • Delivery dates are estimates and not guaranteed but mostly will be within 14 till 30 working days depending on the location. Emerico is not liable for delays beyond its control.
  • Risk of loss or damage passes to the Customer upon delivery.

4.3. Warranty

  • New Products are covered by a manufacturer’s warranty (duration and coverage vary by model).
  • Warranty covers manufacturing defects only. It excludes wear and tear, misuse, neglect, unauthorized repairs, or accidental damage.
  • Warranty claims must be supported by proof of purchase and subject to inspection by Emerico.

4.4. Returns & Exchanges

  • Returns/exchanges are accepted within 7 days of delivery, provided Products are unused, in original packaging, and accompanied by proof of purchase.
  • Custom orders, batteries, and accessories are non-refundable unless faulty.
  • Refunds (if applicable) will be processed after inspection and may exclude delivery/handling charges.

4.5. After-Sales Support

  • Maintenance and repair services are available. Fees may apply for out-of-warranty service or damage outside warranty coverage.
  • Emerico is not liable for loss of use during repairs or servicing.

4.6. Limitation of Liability

  • Emerico is not liable for indirect, incidental, or consequential damages arising from use or inability to use the Product.
  • The Customer is responsible for using the Product according to all instructions, safety guidelines, and local regulations.

5. RENTAL TERMS

5.1. Eligibility & Identification

  • Renters must be at least 18 years old and provide valid government-issued photo identification.
  • A refundable security deposit is required for all rentals.

5.2. Rental Period & Extensions

  • Minimum rental period is one day. Extensions are subject to availability and must be arranged in advance.
  • Late returns incur additional daily fees.

5.3. Delivery & Return

  • Delivery and collection services are available within designated areas and may incur additional fees.
  • The Product, including all accessories and chargers, must be returned in the same condition as received (excluding fair wear and tear).
  • Any loss or damage beyond normal wear and tear will be charged to the renter.

5.4. Use & Care

  • The renter is responsible for safe and proper use of the Product.
  • Products must not be used by minors, under the influence of drugs/alcohol, or for illegal purposes.
  • Products must not be modified, repaired, or serviced by anyone other than Emerico or its authorized representatives.
  • Products must be stored safely and protected from theft, loss, or weather damage.

5.5. Maintenance & Repairs

  • Routine cleaning and care are the responsibility of the renter.
  • Any malfunction or damage must be reported to Emerico immediately. Do not attempt self-repair.
  • The renter is liable for repair or replacement costs resulting from misuse, neglect, or loss.

5.6. Loss, Theft, or Total Damage

  • In case of loss, theft, or irreparable damage, the renter is responsible for the full replacement cost at current retail value.
  • The rental agreement remains in effect and rental fees continue until the replacement cost is settled.

5.7. Cancellation & Refunds

  • Cancellations made at least 24 hours before the rental start date are eligible for a full refund of the deposit.
  • Cancellations less than 24 hours before the rental start date may incur a cancellation fee.

5.8. Liability & Indemnity

  • The renter assumes full liability for any incidents, injuries, or damages arising from use of the Product during the rental period.
  • Emerico is not responsible for personal injury, property damage, or third-party claims resulting from use, misuse, or failure to follow instructions.

6. CUSTOMER OBLIGATIONS

6.1. Customers must comply with all applicable laws and regulations regarding the use, transport, and storage of Products.

6.2. Customers must not sell, rent, sublease, or otherwise transfer Products without written consent from Emerico.

6.3. Customers must not allow unauthorized persons to operate or modify the Products.

6.4. Customers must promptly notify Emerico of any defects, accidents, loss, or theft involving the Products.

7. PRIVACY POLICY

7.1. Personal data collected for purchases or rentals will be handled in accordance with our Privacy Policy, available on our website.

7.2. Identification documents provided for rental or purchase verification will be securely stored and used only for business purposes.

8. FORCE MAJEURE

8.1. Emerico is not liable for delays or failures due to events beyond its reasonable control, including but not limited to natural disasters, strikes, pandemics, or supply chain disruptions.

9. GOVERNING LAW & JURISDICTION

9.1. These T&C are governed by the laws of Malaysia.

9.2. Any disputes shall be resolved in the courts of Malaysia.

10. SEVERABILITY

10.1. If any provision of these T&C is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

11. ENTIRE AGREEMENT

11.1. These T&C constitute the entire agreement between you and Emerico regarding your purchase or rental and supersede any prior agreements or understandings.
